It set forth the manner in which the idea arose, how the plot was discussed; as well as the purchase of the dynamite, the smuggling of it into Canton, and the procuration of persons to buy it in different places; and can surely be considered sufficient evidence to be relied upon against Zang Chu Yun.
Although the prisoner Zang Hsiang Pu only admitted acquaintance with the particulars and said he had not joined in the plot, there is nothing to show that he is not relying upon the absence of evidence with which to confront him, and choosing to incur the lighter penalty so as to escape the heavier. It is of course necessary to summon back the chief accused person Zang Chu Yun, confront him with the witnesses and elucidate the matter, so that the respective cases may be reported upon and dealt with.
We would point out that in the 22nd Year of this reign, His Excellency the former Viceroy Tan, brought about a change in the regulations for extradition of offenders from Hongkong, and it was arranged that in the cases of plotters of murder and other persons involved in capital offences who had offended against the laws in Chinese territory and escaped to Hongkong, a copy of the evidence taken in China should be accepted, provided that the Consul or his Deputy were present at the trial to take a copy of the evidence and make a declaration to the effect that the evidence had been read over to the witness, that the latter acknowledged his statement without hesitation (on hearing it read) and that there was no forcing of evidence or other malpractice. If the Hongkong Authorities could accept the evidence as sufficient, the accused was to be handed over.
The British Colonial Office considered the proposal, and replied that if the accused had not been formerly resident in Hongkong, but had escaped thither after commission of offence, the regulation could be applied. If, however, the accused had in that year been residing for a minimum period of 8 months; although he had committed an offence in the interior, the old regulation and not the new one quoted must be applied. Instructions were issued for this to be put into effect.
The accused Zang Chu Yun was the originator of the plot and is the principal. He belongs to Hsiang Shan and in ordinary times moves about between Hongkong and Macao. Now he has undoubtedly escaped to and is lying perdu in Hongkong, and his case comes within the new regulation for extradition. It is thus our duty to prepare a copy of the evidence, make report, and beg Your Excellency's speedy consideration of the matter, so that the man may be brought back to Canton, brought into Court and tried; thus will the arch-offender be punished and the beginnings of disorder nipped in the bud.
With respect to this report, I have the honour to point out the following facts:-
On 28th October of this year, at the point of dawn, a house in the Hou Lou Fang at the back of the Governor's Yamen was overthrown by an explosion of dynamite. Six persons, men and women, were killed by this and five were wounded. The prisoner Shih Ching Ju admitted on examination that he had been party to a plot of which Zang Chu Yun was the instigator to blow up (certain Yamens).
